Terms and Conditions

This Agreement (“Terms”) constitutes a legally binding contract between you (“Client”, “Participant”, “you”) and Sports Travel Downunder Limited (“Sports Travel Downunder”, “we”, “us”, “our”). By submitting a booking form and/or paying any deposit or fee, you acknowledge that you have read, understood, and agree to be bound by these Terms.


1. Definitions

  • “Tour Package” means the travel, accommodation, race entry and hosted services offered by Sports Travel Downunder.
  • “Supplier” means third-party providers engaged to deliver services, including but not limited to hotels, transport companies, race organisers, and activity operators.
  • “Race Entry Fee” refers to the fee paid by Sports Travel Downunder to secure guaranteed entry on behalf of the Client.
  • “Force Majeure Event” includes any event beyond reasonable control, including natural disasters, war, terrorism, epidemics, pandemics, civil disorder, government action, and airline disruption.

2. Scope of Services

Sports Travel Downunder acts solely as a booking agent and tour co-ordinator.
We arrange travel components and guaranteed race entries but are not the provider of transportation, accommodation, or race events.

We assume no responsibility or liability for the acts, errors, omissions, negligence, or failure of any Supplier.


3. Booking Requirements

A booking is confirmed only once:

  1. A completed booking form is submitted;
  2. The deposit and race entry fee (where applicable) are paid;
  3. These Terms are accepted.

Sports Travel Downunder reserves the right to decline any booking at its absolute discretion.


4. Pricing & Currency

All pricing is stated in New Zealand Dollars (NZD).
Prices may be adjusted at any time due to currency fluctuations, Supplier cost changes, or tax changes, until the Client’s invoice is paid in full.

Should a tax or currency fluctuation of 6% or greater occur between booking and departure, Sports Travel Downunder may apply an additional surcharge.


5. Payments

5.1 Deposits

  • All deposits are non-refundable.
  • Race Entry Fees are non-refundable and non-transferable, as per race organiser policies.
  • Final balance payment is due as specified in the applicable package details

Sports Travel Downunder reserves the right to refuse an Online or Booking Order form application for any reason.  Should your reservation be refused, the full registration fee (including the non-refundable initial deposit) will be refunded to you. Places are limited for the events and are allocated on a first come first served basis.

Sports Travel Downunder will not refund clients who make a reservation and deposit for a program they are not eligible to join.

Failure to pay may result in cancellation of the booking, with all payments forfeited.

5.3 Payment Methods

Accepted: Visa, Mastercard, Amex, bank transfer.
Credit card fees may apply.


6. Cancellations

6.1 Cancellations by the Client

  • Deposits and Race Entry Fees are non-refundable.
  • Cancellations before the final payment date: 50% refund of payments received (excluding deposit and non-refundable fees).
  • Cancellations within 90 days of departure: no refunds.

Chargebacks or disputed credit card charges constitute breach of contract.

6.2 Cancellations by Sports Travel Downunder

We may cancel a tour for safety, operational, or Force Majeure reasons.
Refunds will only be issued if Suppliers refund us.

We are not liable for consequential or incidental losses (airfare, upgrades, visas, insurance, etc.).


7. Amendments & Late Fees

Any change requested after final payment may incur:

  • A NZD $40 administrative change fee, plus
  • Any Supplier-imposed charges.

Changes are not guaranteed and subject to availability.


8. Event Cancellation or Modification

If a race event is cancelled, postponed, or materially altered by the organiser:

  • The Client is bound by the race organiser’s policies.
  • Sports Travel Downunder will refund any race entry and tour package fees paid if possible and only if refunded by the race organisers and suppliers

We are not responsible for travel disruptions resulting from event changes.


9. Travel Documents & Insurance

The Client is solely responsible for:

  • Holding a passport valid 6+ months after return;
  • Securing visas, vaccinations, and travel documents;
  • Purchasing adequate travel insurance (mandatory for participation).

Sports Travel Downunder is not liable for losses arising from failure to obtain required documentation or insurance coverage.


10. Assumption of Risk

By participating in a Tour Package, the Client acknowledges:

  • Marathon running and international travel involve inherent risks, including injury, illness, death, weather disruptions, transportation incidents, civil unrest, and exposure to infectious disease.
  • The Client voluntarily assumes all such risks.

The Client releases and forever discharges Sports Travel Downunder from liability for personal injury, loss, damage, or expenses arising from participation.


11. Limitation of Liability

To the maximum extent permitted by law:

  • Sports Travel Downunder shall not be liable for indirect, incidental, consequential, punitive, or special damages.
  • Our maximum liability shall not exceed the amount paid by the Client to Sports Travel Downunder for the Tour Package.

Nothing in these Terms limits liability for fraud or conduct that cannot be excluded under New Zealand consumer law.


12. Indemnity

The Client agrees to indemnify, defend, and hold harmless Sports Travel Downunder, its employees, directors, officers, and agents from any claim, loss, damages, or expenses arising from:

  • participation in any Tour Package;
  • breach of these Terms;
  • actions or negligence of the Client.

This indemnity survives termination of this Agreement.


13. Behaviour, Safety & Removal

We reserve the right to remove a Client from the tour, without refund, if:

  • behaviour is unsafe or disruptive;
  • illegal substances or prohibited items are possessed;
  • conduct jeopardises the safety or comfort of others.

Clients are responsible for their belongings at all times.


14. Image Release

The Client grants Sports Travel Downunder unrestricted rights to use photographs or video of their participation for marketing, media, and promotional purposes, unless revoked in writing prior to departure.


15. Privacy & Data Use

Personal data will be collected, stored, and used in accordance with our Privacy Policy.
Data may be shared with Suppliers as necessary to deliver the Tour Package.


16. Governing Law

This Agreement is governed by the laws of New Zealand.
Any disputes must be brought in the jurisdiction of Auckland, New Zealand.


17. Dispute Resolution

Before commencing legal action, both parties agree to attempt to resolve disputes through good faith mediation held in Auckland.


18. Severability

If any clause of this Agreement is deemed invalid, the remaining clauses remain in full force and effect.
